Judge: Majority of annexation invalid
District Court Judge Paul Hesse has denied all but one parcel of El Reno’s plan to annex land. The ruling was issued Friday afternoon.
According to Canadian County Court documents, the ruling says El Reno has a valid plan to annex Part A of the annexation territory, but the city’s plan to annex the other areas “B thru F” was ruled invalid.
Part A is just south of I-40 and east of U.S. 81. Hesse said the Plaintiffs in the suit did not have standing in that particular area.
In his ruling, Hesse said the city did not specify a time frame for extending utility services to the areas ruled as “invalid.”
El Reno City Manager Matt Sandidge said the ruling was being studied Friday afternoon and a statement would be issued later.
The city had annexed about 22 square miles of land south and east of the El Reno limits during special city council meetings held last January.
The move drew furious protest from residents in the impacted areas and resulted in a lawsuit.
Running M Farms, LLC filed the suit against The City of El Reno.
It also led to changes in state law that forbid municipalities from annexing land without prior consent of the property owners impacted.
