NOTICE DATE: AUGUST 28TH, 2026

According to the Canadian County Land Records, you are the current registered owner(s) of the property described above, which is located within the City Limits of El Reno, Oklahoma. The condition(s) presently existing at this property is determined to be a public nuisance as defined by the Code of Ordinances of the City of El Reno, Oklahoma, to wit:

PUBLIC NUISANCE #1: FIRE AND LIFE SAFETY HAZARDS

El Reno Municipal Code § 246-1(A) and § 246-1(C)(15), (17), and/or (18); applicable provisions of the 2018 International Fire Code and all adopted fire and life-safety requirements.

The property presently contains conditions that constitute, or are likely to constitute, a fire or life-safety hazard that endanger or are likely to endanger the health, safety, or welfare of the general public.

The August 27, 2026 inspection by the El Reno Fire Marshal was completed with a failing status and identified, among other conditions:

Fire apparatus access road deficiencies, including deficiencies relating to the surface, dimensions, access, and/or gate requirements under IFC §§ 503.2.1, 503.2.3, 503.3, and D103.5, as applicable.

The required Knox Box was present but did not contain the required key(s), as required per IFC §§ 506.1 and 506.2.

Electrical equipment and wiring deficiencies were observed, including an exterior electrical outlet that was not weather-resistant and an interior outlet located in the bathroom required securing, together with a requirement to verify building wiring compliance with the applicable electrical and building codes.

Vegetation was identified as capable of being ignited and endangering property, as outlined in IFC § 304.1.2.

Combustible liquids were observed stored in proximity to ordinary combustibles, contrary to applicable provisions of IFC § 5704.

Portable fire extinguishers were not maintained as required, including the need for annual inspection and mounting as required by IFC § 906.

An AntBox system/equipment component was identified as requiring repair and use in accordance with its listing and applicable installation requirements, including NFPA 70 § 110.3(B).

The private fire-protection/hydrant system was identified as requiring inspection, testing, maintenance, and/or repair as required by IFC § 507.5 and applicable NFPA requirements..

PUBLIC NUISANCE #2: PRIVATE FIRE-PROTECTION WATER SYSTEM FAILURE AND CONTINUING DEFICIENCIES

El Reno Municipal Code § 246-1(C)(15) and (17); IFC § 507.5 and applicable fire-protection requirements.

On or about August 25, 2026, a failure of the property’s private fire-protection water infrastructure resulted in an uncontrolled discharge of approximately 3.8 million gallons of water.

The discharge substantially affected municipal water service, including reduced water pressure and interruption of water service affecting portions of the City. The City was required to take emergency action to shut off the property’s water supply in order to stop the discharge.

The August 27, 2026 Fire Marshal inspection further identified deficiencies involving the property’s private fire hydrant/fire-protection system, including inspection, testing, maintenance, repair, and/or access requirements under IFC § 507.5 and its applicable subsections.

The City therefore finds that the condition of the property’s private fire-protection water system presents a continuing fire, life-safety, and public-welfare concern requiring correction.

PUBLIC NUISANCE #3: DANGEROUS STRUCTURE OR PREMISES

2018 International Property Maintenance Code § 108.1.5.8, as adopted and amended by the City of El Reno, together with El Reno Municipal Code § 246-1.

The property and structures located thereon contain conditions that require correction before the property may safely be occupied or operated.

The City’s records establish that the project has not received a final Certificate of Occupancy and that required building, fire, electrical, civil/drainage, and other inspections and approvals remain incomplete or unresolved.

The property presently remains subject to documented fire and life-safety deficiencies, including the conditions identified in the August 27, 2026 Fire Department inspection.

To the extent that these conditions present a substantial risk of fire, building failure, or other threat to life and safety, the conditions constitute a dangerous structure or premises within the meaning of the applicable property-maintenance requirements and constitute a public nuisance under El Reno Municipal Code § 246-1.

PUBLIC NUISANCE #4: DILAPIDATED BUILDING

El Reno Municipal Code § 246-1(C)(31) and § 246-1(D) and 11 O.S. § 22-112(C): 

(1) A structure which, through neglect or injury, lacks necessary repairs or otherwise is in a state of decay or partial ruin to such an extent that the structure is a hazard to the health, safety, or welfare of the general public.

(2) A structure which is unfit for human occupancy due to the lack of necessary repairs and is considered uninhabitable or is a hazard to the health, safety, and welfare of the general public.

(3) A structure which is determined by the City to be an unsecured building, as defined by 11 O.S. § 22-112.1, more than three times within any twelve-month period.

(4) A structure which has been boarded and secured, as defined by 11 O.S. § 22-112.1, for more than six consecutive months.

(5) Unfit for human occupancy means a structure that due to lack of necessary repairs is considered uninhabitable and is a hazard to the health, safety, and welfare of the general public.

The City’s records establish that the structure/project has remained incomplete and without a Certificate of Occupancy for an extended period, beginning with the City’s inspection and Stop Work Order issued in June 2023 and continuing through the present.

The project has included unresolved and/or incomplete building, fire, electrical, access, drainage, water, fire-protection, inspection, and permitting requirements. The current Fire Department inspection continues to identify conditions affecting fire and life safety.

Prolonged lack of necessary repairs, completion, maintenance, and required safety-related work has resulted in conditions that may satisfy the definition of a dilapidated building because the structure lacks necessary repairs and/or is in such a condition that it constitutes a hazard to the health, safety, or welfare of the general public.

INDEPENDENT CODE & ZONING VIOLATIONS:

The following conditions are also identified as independent code, permit, or zoning violations requiring correction. 

Expired/Inactive Permits. The previously issued building permit is expired. No current building permit authorizing construction or alteration of the property is presently active. A new permit application and required plan review are necessary before additional permitted work may proceed.

Fire Code Violations. The property shall be brought into compliance with all outstanding deficiencies. 

Zoning/Portable Storage Units. Conex-style/portable storage unités located on the property shall be brought into compliance with the applicable provisions of El Reno Municipal Code § 361-16.2, including any required permit, placement, duration, surface, screening, or other requirements, or shall be removed from the property.

Drainage/Detention. The required drainage/detention improvements identified in the City’s project records shall be completed and approved before issuance of a Certificate of Occupancy, consistent with the City’s prior project requirements and applicable approved plans.

Building, Fire, Civil, and Other Inspections. All required inspections and approvals shall be completed and passed before issuance of a Certificate of Occupancy. 

ACTIONS REQUIRED:

The Property Owner is hereby required to bring the property into compliance with all applicable City codes and ordinances. Required corrective actions include, but are not limited to:

  1. Immediately cease any construction, alteration, installation, occupancy, or operation requiring permit, approval, or Certificate of Occupancy unless and until the required authorization has been obtained from the City.
  2. Correct all dilapidated, unsafe, fire and life-safety, property maintenance, and water infrastructure deficiencies.
  3. Obtain all required zoning approvals for the shipping containers or remove the containers from the property.
  4. Maintain the property free of excessive grass and weeds.
  5. Repair the private hydrant and associated water infrastructure.
  6. Pay any lawful costs, fees, or charges assessed by the City pursuant to applicable ordinances or state law, including costs associated with water loss, emergency abatement, inspection, notice, or other authorized abatement activities.

This notice is to inform you that if the public nuisance condition(s) cited above is not corrected within ten (10) days from the date of this Notice, authorized officers of the City of El Reno, Oklahoma, or designated agents thereof, shall take action to abate the public nuisance existing on the property by any procedure necessary.

A bill for all costs and expenses associated with the abatement of this public nuisance shall be prepared by the City Clerk, certified by the City Manager or his designee, and forwarded to you as property owner. Should said bill not be paid in full in the time period allowed by the Code of Ordinances of the City of El Reno, Oklahoma, said costs and expenses shall be certified to the County Treasurer of Canadian County, Oklahoma, and shall be placed upon the tax rolls, and thereby become a lien against the property.

Furthermore, the cost associated with performing the above-described work will become the personal obligation of the Property Owner and could subject the property to foreclosure.

An administrative Hearing will be held on the 14TH DAY OF SEPTEMBER 2026, at three o’clock P.M., at City Hall located at 101 North Choctaw Avenue, El Reno, Oklahoma, 73036. The purpose of this hearing is to determine whether the condition of the property has caused it to become detrimental to the health, benefit, safety and welfare of the general public. If this order has been complied with prior to the administrative hearing date, contact the Code Enforcement Office at 405-262-4070 for reinspection; if compliance is found, no further action will be required on your part, you will not need to appear, and this case will be closed. You or an authorized representative should be present at this hearing.

You may give written consent authorizing the City of El Reno to abate the public nuisance, thereby waiving your right to a hearing. If you so choose to give said written consent, please provide the written consent to the Community Development Department within ten (10) days from the date of this notice.

In addition to the remedies set forth herein, the City of El Reno shall also have the right to exercise any other remedies that might be available to it under Oklahoma law.
